Terms of Use

1. About LandscapeTrade

LandscapeTrade is an online marketplace operated by Landscape Queensland Industries Association Incorporated (ABN 92 439 102 270) ("Landscape Queensland") that allows members of Queensland's landscaping industry to buy, sell, trade and lease equipment, materials and other industry assets.

Landscape Queensland operates LandscapeTrade as a facilitation service only. Landscape Queensland is not a party to any transaction conducted through the platform.

2. Acceptance of Terms

By accessing or using LandscapeTrade, you agree to these Terms of Use. If you do not agree, do not use the platform. These terms apply to all users, including buyers, sellers, lessors and lessees.

3. Landscape Queensland's Role

Landscape Queensland provides the platform infrastructure. It does not:

• Inspect, verify or warrant the condition, accuracy or legality of any listing
• Act as agent, broker or representative for any user
• Facilitate, hold or transfer payment
• Guarantee that any transaction will be completed

All transactions are conducted directly between the buyer and seller (or lessor and lessee). Landscape Queensland is not a party to those transactions.

4. User Responsibilities

You are responsible for:

• The accuracy and legality of any listing you post
• Conducting your own due diligence before entering any transaction
• Complying with all applicable laws, including consumer protection and sale of goods legislation
• Honouring commitments made to other users
• Any dispute arising from a transaction you enter into

5. Listings

Listings must be genuine, accurate and for items lawfully available for sale, trade or lease. You must not post fraudulent, misleading or prohibited listings. Landscape Queensland reserves the right to remove any listing at its discretion without notice.

6. Prohibited Uses

You must not use LandscapeTrade to:

• Post false, misleading or deceptive content
• Harass, threaten or defraud other users
• Circumvent platform systems or extract user data
• Conduct transactions involving stolen, illegal or unsafe goods
• Impersonate another person or organisation

7. Limitation of Liability

To the maximum extent permitted by law, Landscape Queensland excludes all liability for any loss or damage arising from your use of LandscapeTrade, including loss arising from a transaction, a failed transaction, a fraudulent listing or a dispute between users.

Nothing in these terms excludes any guarantee, warranty or right that cannot be excluded under the Australian Consumer Law.

8. Account Termination

Landscape Queensland may suspend or terminate your access to LandscapeTrade at any time if you breach these terms or act in a way that is harmful to other users or to the platform.

9. Changes to These Terms

Landscape Queensland may update these terms at any time. Continued use of the platform after an update constitutes acceptance of the revised terms. Material changes will be notified via the platform or by email.

10. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes relating to these terms are subject to the exclusive jurisdiction of the courts of Queensland.
